neither I, nor anyone at my residence is currently a DIRECT TV subscriber, nor have ever been a DIRECT TV subscriber. (If you\'re currently a DIRECT TV customer and purchasing just a receiver, this line is not applicable.)

To activate my system and all receivers with Total Choice Programming ($39.99/mo. with Local Channels) or greater within 31 days of receipt. ALL RECEIVERS PURCHASED MUST BE ACTIVATED AT THE SAME TIME AND ALL RECEIVERS MUST MAINTAIN AT LEAST 12 CONSECUTIVE MONTHS OF DIRECT TV® PROGRAMMING, $39.99 TOTAL CHOICE® OR ABOVE.

To activate the system at the residential location provided with my order (you also must activate with the same phone you provided us as well.)

That if I do not comply with all the terms of this agreement, I hereby authorize Direct tv usa to charge my credit card a fee of $175 for each receiver that was purchased.

That the shipping and handling fee is non-refundable.

That if for any reason I decide to return the equipment prior to activation, I am responsible for any shipping fees incurred.

That in order to receive DIRECT TV service I must have a clear and unobstructed view to the southern skies over USA.

I am subject to a credit check by DIRECT TV at the time of activation.

Direct TV USA Satellite is not responsible for any overdraft/over-the-limit charges or bank fees if your account contains insufficient funds when your order is processed, billed, or assessed any non-activation fees. To prevent this from happening, we recommend using a credit card rather than a debit card.

I also understand that my purchase includes FREE standard professional installation, and that I am responsible to pay the installer for any custom work required.

Activation Commitment: Within 30 days of purchase of your DIRECT TV System equipment, you agree to activate a DIRECT TV programming package valued at $39.99 per month or above, or DIRECT TV PARA TODOS™ OPCIÓN ESPECIAL or above, or Phoenix TV programming package. You also agree to activate DIRECT TV programming on any additional receivers ($4.99 per month per additional receiver as long as all receivers are connected to the same phone line). Existing DIRECT TV customers may activate receivers with their existing DIRECT TV® programming package.

Consequences of Your Failure to Activate Programming: If you fail to activate your DIRECT TV System equipment within 30 days of purchase date, you agree that Expert Satellite may charge a fee of one hundred seventy-five U.S. dollars as liquidated damages, per DIRECT TV System that is not activated.

DIRECT TV ANNUAL PROGRAMMING COMMITMENT -

Programming Commitment: Within 30 days of purchase of your DIRECT TV System equipment, you agree to activate a DIRECT TV® TOTAL CHOICE® programming package valued at $39.99 per month or above or DIRECT TV PARA TO DOS™ OPTION ESPECIAL® or above or Phoenix TV programming package, and maintain such programming package for a period of twelve (12) consecutive months (without interruption) for each DIRECT TV System purchased by you, including additional DIRECT TV receivers ($4.99 per month per additional receiver as long as all receivers are connected to the same phone line). After you have fulfilled your twelve (12) month commitment to the required programming package, you are not obligated to continue your subscription for DIRECT TV® programming for any specific duration. Existing DIRECT TV customers may activate additional receivers with their existing DIRECT TV® programming package.

Consequences of Your Failure to Maintain Programming Commitment: If you fail to maintain and pay for twelve (12) consecutive months of the required programming package, you agree that DIRECT TV may charge you a prorated fee of up to one hundred fifty U.S. dollars ($150.00).

THIS PROGRAMMING COMMITMENT IS SEPARATE AND DIFFERENT FROM ANY OTHER ANNUAL COMMITMENT YOU MAY HAVE PREVIOUSLY MADE WITH DIRECT TV AND IS FULLY ENFORCEABLE UNDER THESE TERMS.

DIRECT TV Customer Agreement: You hereby agree and acknowledge that this DIRECT TV Annual Programming Commitment Agreement sets forth additional terms and conditions regarding your receipt of DIRECT TV® programming and activation of access cards and shall be applied in conjunction with the DIRECT TV Customer Agreement, a copy of which is provided at DIRECT TV.com and with your first bill.

Arbitration: You and DIRECT TV agree that both parties will resolve any dispute arising under this Agreement through binding arbitration as set forth in the DIRECT TV Customer Agreement.

Customers in NR TC Territory: This Agreement does not apply to customers who activate DIRECT TV System equipment in a territory served by members or affiliates of the National Rural Telecommunications Cooperative. Thank you for choosing to purchase DIRECT TV System equipment. By signing this Annual Programming Commitment Agreement, Customer (hereafter referred to as “I”/”me”/“you”/”your”) agrees to abide by the following terms and conditions.

STANDARD PROFESSIONAL INSTALLATION CONDITIONS -

The following is included with a single-room installation:

All customers renting townhouses, apartments, condo\'s, etc., will need to provide the installer written permission from the landlord prior to installation.
Completion of a site survey with customer\'s permission.
Planning the installation with the customer (cable routing, antenna location, connection of devices and discussing future options).
Notification to customer of any additional (nonstandard) charges prior to commencement of any work.
Properly routing and aligning an 18 inch dish satellite antenna with dual output LNB.
Routing and properly attaching up to 125 feet of quality REG6 cable.
Cable routing through one exterior and one interior wall.
Grounding to meet Local/NEC requirements.
Installation of one DIRECT TV System IRD (receiver).
Connection to an active telephone line within twenty-five (25) feet, capable of dialing out.
Tuning the antenna alignment to peak performance.
Completion of a system test verifying signal strengths, access card match, and telephone connectivity.
Connection of VCR (if applicable).
Cleaning up any mess made during installation and removing debris from the customer\'s residence.
Activation of DIRECT TV programming with the customer on the phone.
Customer education on system operation and features.
Leaving installation company name and television with the customer, enabling them to contact the installation
contractor directly if there are any problems with the installation.

Add these steps for each additional receiver purchased:

Routing and properly attaching quality REG6 cable to second TV (within 125 feet as described above).
Installation of second DIRECT TV Receiver to second TV.
Connection of second DIRECT TV Receiver to the same active telephone line within twenty-five (25) feet, capable of dialing out.
Connection of VCR (if applicable).

NON-STANDARD INSTALLATION FEES:
Additional work is payable directly to the installer at time of installation. Prices will fluctuate due to circumstances from one installer to another. The prices below are an average and should be used as a guideline only. Here are some of the most common scenarios:

Cable burial up to 100 feet - Approx. $1 per foot
Attic/Crawl Space - By Quote
Extra TV hook up (no wall fishing, no DIRECT TV receiver) - Approx. $50-75
Wall fishing - Approx. $45 per hour
Ground pole installation - Approx. $75
Chimney mount - Approx. $45
Connection of co-located devices (existing surround sound, DVD, video games, etc.) - Approx $5-$25
40 foot ladder charge for installs that are applicable - Approx $70

You agree that each of the above installation points are acceptable. You also agree that any variances from a standard professional installation (outlined above) will be your financial responsibility. As stated above, this fee (if any nonstandard installation work is required) will be discussed with you by the contractor prior to installation. Also, you understand that each DIRECT TV Receiver must be connected to a land line Coupons and Providers phone connection. These receivers must be connected to a phone line; however, they will never interfere with your telephone connection and will allow you to operate your telephone normally. No additional or new phone line is needed.
